FotoBite Pro Subscription and Bites Terms

These Terms govern the paid FotoBite Pro subscription and the use of bites in the FotoBite Telegram Mini App and Telegram bot (the "Service"). The free tier remains available at no charge. Paying for Pro or for a bite pack constitutes acceptance of these Terms.

Provider:

1. What Free and Pro provide

Free and Pro use the same available features. The only difference is how many free bites are added for each diary day.

The Service therefore does not promise a separate fixed number of AI analyses per day: the remaining balance depends on which AI actions use the bites. For example, if daily bites are used only for photo analysis, 30 bites cover 3 analyses and 200 cover 20. Technical limits on attempts, request rates, and overall AI availability also apply to protect the Service.

Moving to Free does not limit how far back diary history is shown.

2. How bites work

A bite is an in-Service unit used to pay for AI actions.

Bites are finally charged only when the Service actually calls an AI model. If a result is found without such a call, or the AI action fails, the bites charged for it are returned to the same balance.

Daily bites do not carry over to the next day. They refill at the diary-day boundary — 03:00 in the timezone specified in the user's profile. The Service spends daily bites first, followed by purchased bites.

The Service offers a one-off pack of 100 purchased bites for 29 ⭐. A pack purchase does not auto-renew and does not provide Pro access. Purchased bites are valid for one year from purchase and are not reset when the diary day changes.

3. Plans and price

Payment is made in Telegram Stars (⭐) via Telegram's built-in payments.

Only the monthly plan is an auto-renewing Telegram Stars subscription, charged automatically every 30 days until cancelled. The quarterly and yearly plans are one-off payments: they extend access by the corresponding period and are not charged again automatically.

The fiat value of Stars is set by Telegram and is outside the Provider's control.

4. Price changes

The Provider may change plan prices with at least 30 days' notice. Changes do not affect an already-paid period.

5. Cancellation

You can cancel the monthly plan's auto-renewal at any time:

• in the Mini App: Profile → subscription section → "Cancel renewal";

• via Telegram (Stars subscription management).

After cancellation, Pro access continues until the end of the already-paid period and is not renewed thereafter. One-off plans (quarter/year) need no cancellation — they do not renew.

6. Refunds

6.1. 14-day money-back guarantee

Within 14 calendar days of any payment, you may receive a full refund of the Stars paid for any reason. There is no Service-usage condition: the guarantee also applies if bites received for the payment have already been spent.

When a payment is refunded, any Pro access it provided ends and the unspent remainder of the bites it provided is revoked. Bites already spent do not create a debt or restrict your right to a refund. Your bite balance may therefore fall to zero after a refund. This is information about the effect of a refund, not a restriction on your right to receive one.

Telegram only supports full-amount refunds (no partial refunds), so a refund means the full Stars amount is returned.

6.2. Non-delivery

If the Service failed to deliver the paid functionality due to a technical fault on our side, a refund is issued regardless of timing — in line with Telegram's rules for digital goods.

6.3. Erroneous and unauthorised charges

Duplicate charges and charges made without the account owner's knowledge are refunded after verification.

6.4. After 14 days

After 14 days, a refund for the unused period is at the Provider's discretion; as a rule no refund is given if the subscription was actively used. For the auto-renewing plan, a reminder is sent before each charge so renewal can be cancelled in advance.

6.5. How to request a refund

Send the /paysupport command in the bot, or email [email protected] with the payment date. The transaction ID is available in Telegram: Settings → Your Stars.

6.6. Refunds after account deletion

Deleting your account does not remove your right to a refund under clauses 6.1–6.4. So that a refund remains technically possible, we retain a separate payment record after deletion: the Telegram transaction identifier, the payer's Telegram identifier, the amount in Stars, the plan purchased, the payment date and a refunded flag. This record contains no food diary, health, weight or other service data, and is kept for 3 years from the payment date.

7. No medical guarantees

The Service provides approximate calorie and macronutrient estimates and is not a medical service. Estimates may contain error. The Service does not replace advice from a doctor or dietitian.

8. Governing law and disputes

These Terms are governed by the law of the Provider's country of registration. Disputes are resolved through negotiation; failing agreement, under applicable law, including consumer-protection rules of the consumer's country of residence where they provide greater protection.
